4.3  The Culture Agency name, logo, and service names are trademarks of Culture Agency Pty Ltd. You may not use these marks without our prior written permission.

4.4  You may view and download Content for personal, non-commercial reference only, provided you maintain all copyright and proprietary notices. This permission does not extend to Proprietary Frameworks, which may not be reproduced in any form.

5. Published Content and Professional Boundaries

The Website Privacy Policy does not apply to program delivery data.

10.3  We process personal data in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

11. Disclaimer

11.1  This Website and its Content are provided on an "as is" and "as available" basis.

11.2  To the extent permitted by law, we do not warrant that:

  1. The Website will be available without interruption or error

  2. Content is accurate, complete, or current at all times

  3. The Website is free from viruses or other harmful components

12.2  Our total aggregate liability arising from or in connection with your use of this Website shall not exceed AUD $100.

12.3  The limitations in this section apply to liability arising from Website use only. Liability in connection with the delivery of our programs and services is governed by the applicable Service Agreement.

Australian Consumer Law

12.4  Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

12.5  To the extent that we are entitled to limit our liability under the Australian Consumer Law, our liability is limited, at our option, to the resupply of the relevant services or the payment of the cost of having the relevant services supplied again.

13. Relationship Between Website Terms and Service Agreements

13.1  These Terms govern your use of this Website only. They do not govern the delivery of our culture development programs, assessments, coaching, consulting, or any other professional services.

13.2  If you engage our services, the terms of that engagement will be set out in a separate Service Agreement. In the event of any inconsistency between these Website Terms and a Service Agreement, the Service Agreement will prevail to the extent of the inconsistency.

13.3  Nothing on this Website constitutes an offer to provide services. All service engagements are subject to a separate agreement and our acceptance.

14. Governing Law

14.1  These Terms are governed by the laws of Queensland, Australia.

14.2  Any disputes arising from or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

15. General

15.1  These Terms, together with our Website Privacy Policy, constitute the entire agreement between you and Culture Agency regarding your use of this Website.

15.2  If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

15.3  Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

15.4  You may not assign or transfer any rights or obligations under these Terms without our prior written consent.
